Last updated: 9 Dec 2025
1. Acceptance of terms
These Terms of Use (“Terms”) govern your access to and use of the website operated by Western CPA Professional Corporation (“Western CPA”, “we”, “us”, “our”), including our booking pages, online forms, chat widgets, and any content, functionality, or services offered through them (collectively, the “Site”).
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.
2. No professional advice or engagement created by the Site
The information on this Site is provided for general information purposes only and does not constitute tax, accounting, legal, or financial advice.
- Viewing the Site, submitting a form, using the chat widget, or booking an initial consultation does not by itself create a client–professional relationship with Western CPA.
- A formal client relationship is only established once we complete our intake process and both parties sign an engagement letter.
You should not act or refrain from acting based solely on information on this Site without seeking appropriate professional advice.
3. Use of the Site
You agree to:
- Use the Site only for lawful purposes and in accordance with these Terms
- Provide accurate and complete information when submitting forms or booking appointments
- Not attempt to interfere with the security or proper functioning of the Site
- Not upload or transmit any malicious code, spam, or content that is unlawful, harmful, defamatory, or infringing
We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.
4. Appointments and cancellations
Our online booking tools allow you to request appointments with our professionals.
- Appointment times are offered based on current availability and may be subject to change.
- We may contact you to confirm, reschedule, or cancel an appointment if necessary (for example, in case of conflicts, staffing changes, or incomplete information).
- You are responsible for ensuring we have accurate contact details so we can reach you with confirmations or changes.
Any specific engagement terms, fees, scope of services, and responsibilities will be set out in a separate engagement letter.
5. Communications, email, and SMS
By submitting your contact information and, where required, checking a consent box, you agree that we may contact you by email, phone, or SMS text as described in our Privacy Policy.
- SMS communications may include appointment confirmations, reminders, tax-season alerts, and occasional client messages such as birthday or holiday greetings.
- Message and data rates may apply.
- You can opt out of SMS at any time by replying STOP to any message, and you can change your email preferences using the instructions in our emails.
Electronic communications are not always secure. Please avoid sending highly sensitive financial or personal information through unencrypted email or chat.
6. Intellectual property
Unless otherwise stated, all content on the Site—including text, graphics, logos, icons, images, and design—is the property of Western CPA or its licensors and is protected by copyright and other intellectual property laws.
You may view and print content for your personal, non-commercial use only. You may not reproduce, modify, distribute, or publicly display any content from the Site without our prior written consent.
7. Third-party services and links
The Site may include links or access to third-party websites, tools, or services (such as booking platforms, secure file portals, or payment processors). These are provided for convenience only.
We do not control and are not responsible for the content, policies, or practices of third parties. Your use of third-party services is subject to their own terms and policies.
8. Disclaimers
The Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Site will be uninterrupted or error-free
- Defects will be corrected
- The Site or the server that makes it available are free of viruses or other harmful components
- The information on the Site is complete, accurate, or up to date at all times
Any use of the Site and reliance on its content is at your own risk.
9. Limitation of liability
To the fullest extent permitted by law, Western CPA, its partners, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of profits or data, arising out of or in connection with your use of the Site.
Our total aggregate liability for any direct damages arising from your use of the Site will be limited to the amount, if any, paid by you to use the Site.
Nothing in these Terms limits any liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Western CPA and its partners, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Site
- Your breach of these Terms
- Your violation of any applicable law or third-party rights
11. Governing law and jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
